It is important for the party seeking the rent arbitration that before the 'termination date' either a new rent should be agreed, or an arbitrator appointed by agreement, or an application made to the RICS before that date to appoint an arbitrator. If not, the arbitration demand lapses (section 12 Agricultural Holdings Act 1986). 4 Rent increase for landlord's improvements Where the landlord carries out improvements on the holding 'at the request of, or in agreement with, the tenant' or under certain statutory provisions, he is entitled to increase the rent, regardless of the three year rule mentioned above, provided he gives the tenant written notice within six months from completion of the improvement (section 13 Agricultural Holdings Act 1986).

1 Introduction The law of agricultural holdings is extremely technical and complex. In particular, attention must be paid to the prescribed forms and time limits. This chapter can only give a superficial outline of the legislation. 2 Definitions The current legislation protecting agricultural tenants whose tenancies pre-date 1 September 1995 is the Agricultural Holdings Act 1986. The legislation provides security of tenure for the tenant, regulates the terms of the tenancy and provides for compensation for the tenant on its termination.

Should he refuse to give his consent the tenant has no appeal to an arbitrator. 7 Application to arbitrator For improvements, other than planning permission, a tenant may give to his landlord a notice in writing demanding arbitration (section 19(1) Agricultural Tenancies Act 1995) where he is aggrieved because his landlord • • • has refused to give consent to an improvement; or has failed to give consent to the improvement within two months of the tenant's written request for such consent; or has required the tenant to agree a variation in the terms of the tenancy as a condition of giving such consent.
